1. Basic information and controller

This privacy policy is intended to inform users of this website about the type, scope and purpose of the collection and use of personal data by the website operator GATRA Modellbau Union, Inh. 2. Collection and storage of personal data; type, purpose and use; duration of storage

The use of the websites at www.gatra-modellbau.com is generally possible without providing personal data. If you contact us or place an order, the following data are collected and processed:

• Business or private address, delivery addresses
• Email address
• Telephone number
• Fax number
• VAT identification number
• IP address

In addition, all information that is necessary in order to fulfil a contract with you is collected and processed.

The collection of personal data takes place in order

• to be able to fulfil our contractual obligations towards you,
• to be able to comply with our legal obligations,
• for invoicing and, where applicable, for dunning procedures,

The processing of personal data is required for the purposes mentioned in order to process your request and to fulfil obligations arising from an underlying contractual relationship.

The collected personal data are stored until the end of the statutory retention periods for merchants (6, 8 or 10 years after the end of the calendar year in which the contractual relationship ended) and then deleted. This does not apply if we are obliged to store the data for a longer period due to tax or commercial law retention obligations (pursuant to HGB, StGB or AO) or if you have consented to storage beyond this period.

3. Contact form

The processing of the data transmitted via the contact form is for the purpose of contacting you. By sending your message you consent to the processing of the transmitted data. Processing is based on Art. 6 para. 1 letter a GDPR. We use your data only to process your enquiry; they are deleted once your request has been dealt with, unless storage is required for other reasons.

4. Customer account

GATRA Modellbau Union supplies both consumers and resellers inside and outside the European Union. In order to display binding prices to you in the legally required form, it is necessary to create a customer account. Data processing also serves the purpose of simplifying the processing of your orders. Processing is based on Art. 6 para. 1 letters a, b, c GDPR.

You can at any time view and update the data stored about you and delete your customer account completely in the "My account" area.

5. Orders

For the fulfilment and processing of your order we use exclusively the data stored in your customer account or data that you have provided to us in another way. Providing the data is required for the conclusion of the contract. If the data are not provided, no contract can be concluded. Processing is based on Art. 6 para. 1 letter b GDPR.

6. Newsletter, request to rate shop and products

We use your data independently of contract processing exclusively for our own advertising purposes. A newsletter is sent only if you have expressly agreed to this. Processing is based on Art. 6 para. 1 letter a GDPR.

You can unsubscribe from the newsletter at any time by using the corresponding link in the newsletter, via a setting in your customer account or by sending us a message in text form. Your email address will then no longer be used for advertising purposes. Messages in connection with orders and our statutory information obligations are not affected by this setting.

Furthermore, we use your data in order to ask you once, a few days after delivery of your order, to rate the processing of your order and the products received. Such ratings are in the interest of the general public, the use of email addresses for this purpose is permitted and does not constitute unfair competition within the meaning of § 7 UWG. You can unsubscribe from these messages at any time by using the corresponding link in the email.

7. Use of PayPal

8. Disclosure of data

Your data will not be passed on to third parties without your express consent. The only exceptions are our service partners whom we need in order to process the contractual relationship or service providers whom we use within the framework of processing on our behalf.

10. Online functions

10.1 Server log files

When you access our website, our hosting provider IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany, automatically processes technical access data. According to IONOS, these data are anonymised directly upon collection. The following information is recorded:

• Referrer, i.e. the website visited previously
• Requested page or file
• Browser type and browser version
• Operating system used
• Device type used
• Time of access
• IP address in anonymised form; according to IONOS, it is used only to determine the location of the access

According to IONOS, these visitor data are stored for eight weeks. The processing serves to ensure the security and stability of the web hosting service and the reliable technical provision of the website.

We may evaluate the server log files provided to us by IONOS where necessary for error analysis and for investigating specific security incidents. To the extent that this processing falls within our responsibility, it is based on Art. 6 para. 1 letter f GDPR. Our legitimate interest lies in the secure, stable and technically reliable operation of our website.

10.2 Cookies
